1About Gateway and our services关于 Gateway 及我们的服务

Gateway International Education is an Australian-based educational advisory. We help Chinese families consider, choose and apply to Australian boarding schools, and we support students and families before, during and after the move. The specific services, scope and fees for any engagement are set out in a separate written services agreement provided to you before the engagement begins. Gateway 国际教育是一家常驻澳大利亚的教育顾问机构。我们协助中国家庭了解、选择并申请澳大利亚寄宿学校，并在孩子赴澳前、在校期间及之后为学生与家庭提供支持。任何具体委托的服务内容、范围及费用，将在服务开始前以另行签署的书面服务协议载明。

2What we do not do我们不提供的服务

Gateway provides educational advisory services only. Gateway is not a registered migration agent and does not provide immigration assistance, migration advice, visa strategy, or visa application services. Where a visa matter arises, we may introduce families to a registered migration agent or Australian legal practitioner. Gateway's role is limited to education advisory, school coordination, and administrative document organisation where this does not involve immigration assistance. Gateway 仅提供教育咨询服务。Gateway 不是注册移民代理，不提供移民协助、移民建议、签证策略或签证申请服务。如涉及签证事宜，我们可为家庭引荐注册移民代理或澳大利亚法律执业人士。Gateway 的职责仅限于教育咨询、学校协调，以及不涉及移民协助的行政材料整理工作。

We are not lawyers, financial advisers or medical professionals, and nothing we provide is legal, financial or medical advice. 我们不是律师、财务顾问或医疗专业人士，我们所提供的任何内容均不构成法律、财务或医疗建议。

3No guarantee of outcomes不保证结果

Gateway does not control the decisions of schools, migration authorities, guardianship providers, accommodation providers or other third parties. Gateway does not guarantee school admission, scholarship offers, visa approval, accommodation placement, guardianship approval, particular academic performance, or any other particular educational or personal outcome. Gateway 无法决定学校、移民主管部门、监护服务机构、住宿服务机构或其他第三方所作的决定。Gateway 不保证学校录取、奖学金录取、签证批准、住宿安排、监护核准、特定学业表现，或任何其他特定的教育或个人结果。

School fees, places and entry requirements are set by the schools and may change. 学校的费用、学位及入学要求均由学校自行制定，并可能发生变动。

4Your responsibilities家庭的责任

Gateway provides guidance, information and coordination. The decisions remain yours. Families remain responsible for independently assessing whether a school, guardian, accommodation provider, registered migration agent or other service is suitable for the student, and for making the final choice. We encourage families to review schools and providers directly, ask their own questions, and obtain independent advice where appropriate. Gateway 提供的是指导、信息与协调。最终的决定权始终在您。家庭须自行独立评估某一学校、监护人、住宿服务机构、注册移民代理或其他服务是否适合该学生，并自行作出最终选择。我们鼓励家庭直接考察学校与服务机构、自行提出疑问，并在适当情况下寻求独立的专业意见。

You are responsible for the accuracy and completeness of the information you provide to us and to third parties. 您须对自己向我们及第三方所提供信息的准确性与完整性负责。

5Engaging our services and fees委托服务与费用

Any engagement of our services is governed by a separate written services agreement. That agreement sets out the scope of work, fees, payment terms, refund and cancellation arrangements. These Terms apply alongside that agreement. If there is any inconsistency between these Terms and a signed services agreement, the services agreement prevails for that engagement. 对我们服务的任何委托，均以另行签署的书面服务协议为准。该协议将载明工作范围、费用、付款条件、退款及取消安排。本条款与该协议并行适用。如本条款与已签署的服务协议存在任何不一致之处，就该项委托而言，以服务协议为准。

6Schools, migration agents and other third parties学校、移民代理及其他第三方

In the course of an engagement we may introduce or coordinate with third parties, including schools, registered migration agents, guardians, host families and testing providers. These third parties are independent of Gateway. We take care in who we work with, but we are not responsible for the acts, omissions, services, fees or decisions of any third party. Any arrangement you enter into with a third party is between you and that party. 在服务过程中，我们可能引荐第三方或与之协调，包括学校、注册移民代理、监护人、寄宿家庭及测试机构。这些第三方独立于 Gateway。我们会审慎选择合作对象，但对任何第三方的作为、不作为、所提供的服务、收取的费用或所作的决定概不负责。您与任何第三方达成的任何安排，均属您与该方之间的事务。

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under that law where it cannot lawfully be excluded. • Gateway is not liable for loss or damage caused by the acts, omissions or decisions of any third party, including schools, registered migration agents, guardians and accommodation providers; and 对于因任何第三方（包括学校、注册移民代理、监护人及住宿服务机构）的作为、不作为或决定所造成的损失或损害，Gateway 概不负责；以及
• Gateway's total aggregate liability to you in connection with our services, however arising, is limited to the total fees paid by you to Gateway under the relevant engagement in the twelve (12) months before the event giving rise to the claim. 就我们的服务而言，无论因何种原因产生，Gateway 对您承担的责任总额，以您在引致索赔的事件发生前十二（12）个月内，就相关委托向 Gateway 实际支付的费用总额为上限。

Where liability for failure to comply with a consumer guarantee can be limited, Gateway's liability is limited, at our option, to resupplying the relevant service or paying the cost of resupply. The detailed liability terms for a paid engagement are set out in the services agreement. 在因未能遵守消费者保障而产生的责任可予限制的情形下，Gateway 的责任以（由我们选择）重新提供相关服务或支付重新提供该服务的费用为限。付费委托的详细责任条款，载于服务协议中。

10Indemnity赔偿

To the extent permitted by law, you agree to compensate Gateway for direct loss or liability that Gateway reasonably incurs as a result of your breach of these Terms, or as a result of false, inaccurate or misleading information you provide to us or to a third party. This does not apply to the extent the loss is caused by Gateway's own negligence or breach. 在法律允许的范围内，对于因您违反本条款，或因您向我们或第三方提供虚假、不准确或具误导性信息，而导致 Gateway 合理产生的直接损失或责任，您同意予以补偿。但在相关损失系由 Gateway 自身的疏忽或违约所致的范围内，本条不适用。

11Suspension and termination中止与终止

Either party may end an engagement in accordance with the services agreement. Gateway may also suspend or stop providing services, or restrict access to this website, if you breach these Terms, provide false information, or behave unlawfully or abusively. Ending an engagement does not affect rights or obligations that arose beforehand; fees already incurred remain payable, and any refund is dealt with under the services agreement. 任何一方均可依照服务协议终止委托。此外，如您违反本条款、提供虚假信息，或有违法或侮辱性行为，Gateway 亦可中止或停止提供服务，或限制您访问本网站。委托的终止不影响在此之前已产生的权利或义务；已产生的费用仍应支付，任何退款均按服务协议处理。

12Resolving disputes争议解决

If a concern or dispute arises, please contact us first so we can try to resolve it in good faith. If it is not resolved within 30 days, the parties will attempt in good faith to resolve it through mediation administered by a recognised Australian mediation body before starting court proceedings. Nothing in this clause prevents either party from seeking urgent relief from a court, or from contacting a relevant ombudsman, tribunal or regulator. 如出现疑虑或争议，请先与我们联系，以便我们本着诚信原则尝试予以解决。如争议在 30 天内未获解决，双方应在提起诉讼之前，本着诚信原则，尝试通过由澳大利亚认可的调解机构主持的调解程序加以解决。本条款中的任何内容，均不妨碍任何一方向法院寻求紧急救济，或向相关的申诉专员、仲裁裁判机构或监管机构提出请求。

13Events beyond our control不可抗力

Gateway is not liable for any delay in, or failure of, performance caused by events beyond its reasonable control. These include natural disasters, epidemics or pandemics, government action, border or travel restrictions, changes to visa or education policy, school closures, and failures of communications, payment systems or transport. 对于因其合理控制范围之外的事件所导致的履约延迟或履约失败，Gateway 概不负责。此类事件包括自然灾害、流行病或大流行病、政府行为、边境或旅行限制、签证或教育政策的变动、学校停课，以及通信、支付系统或交通运输的故障。

14Electronic communications电子通信

You consent to receiving communications from us electronically, including by email, WeChat, WhatsApp and through this website, and you agree that electronic communications satisfy any legal requirement that a communication be in writing. We may update these Terms from time to time. The current version will always be available on our website, with the date it was last updated shown above.
